Terms of Service

Article I — Platform Description and Operator Status

Yowoxu Gisozi (hereinafter "the Platform") is an online marketplace operated through the domain yowoxu-gisozi.info that facilitates connections between persons who own equipment (hereinafter "Owners") and persons who wish to rent equipment for short-term periods (hereinafter "Renters"), collectively referred to as "Users." The Platform operator provides listing infrastructure, a booking system with calendar availability, standardised rental agreement generation, damage deposit handling and delivery coordination services. The Platform operator does not own any equipment listed on the Platform, does not take possession of equipment at any point in the rental process, and does not act as a party to the rental agreement concluded between Owner and Renter. The Platform operator does not provide, arrange or broker insurance products of any kind. These Terms of Service constitute a binding agreement between each User and the Platform operator, governing access to and use of the Platform.

Article II — Acceptance of Terms and Eligibility

Access to and use of the Platform is conditional upon acceptance of these Terms of Service in their entirety. By registering an account, creating a listing, submitting a booking request or otherwise using the Platform's functionality, a User confirms their acceptance of these terms. Users must be natural persons aged 18 years or over, or legal persons duly incorporated under applicable law, with full legal capacity to enter into binding agreements. The Platform is intended for use in connection with lawful commercial or personal equipment rental transactions. Use of the Platform for any unlawful purpose, or in any manner inconsistent with these terms, is prohibited. The Platform operator reserves the right to refuse registration or to suspend or terminate accounts where these conditions are not met.

Article III — Owner Obligations and Listing Standards

Owners who create listings on the Platform represent and warrant that: (a) they are the lawful owner of the listed equipment or are otherwise authorised to make it available for rental; (b) the equipment is accurately described in the listing, including its condition, specifications and any limitations on use; (c) the equipment is fit for the purpose described and complies with all applicable safety requirements under Polish law, including where relevant the Act on Technical Inspection (Ustawa o dozorze technicznym) and applicable occupational health and safety regulations; (d) the availability calendar is maintained accurately and reflects the genuine availability of the equipment; (e) the rental rate stated in the listing is the rate at which the Owner agrees to rent the equipment. Owners are responsible for ensuring that their equipment listings do not contain false, misleading or incomplete information. The Platform operator reserves the right to remove listings that do not comply with these standards or with the Platform's content guidelines.

Article IV — Booking Process and Rental Agreement

A booking is initiated when a Renter submits a booking request for a listed item for a specified period. The booking request does not constitute a concluded agreement. A rental agreement is concluded when the Owner confirms the booking request through the Platform. Upon confirmation, the Platform automatically generates a standardised rental agreement pre-populated with the specific details of the transaction, including equipment description, rental period, agreed rate, deposit amount and delivery terms. Both parties receive a copy of the generated agreement. The standardised agreement template is designed to address key terms applicable to short-term equipment hire under the Polish Civil Code (Kodeks cywilny). Users acknowledge that the Platform operator is not a party to the rental agreement and that the rights and obligations under the agreement are those of the Owner and Renter respectively. Users are advised to review the generated agreement carefully before the rental period commences.

Article V — Damage Deposits

The Platform facilitates the collection of a damage deposit from the Renter at the time of booking confirmation. The deposit amount is set by the Owner within parameters established by the Platform. The deposit is held through the Platform's payment infrastructure during the rental period. Following the return of the equipment, the Owner and Renter are required to complete an inspection process as documented within the Platform. Where both parties confirm that the equipment has been returned in the agreed condition, the deposit is released to the Renter within the timeframe specified in the Platform's operational procedures. Where the Owner reports damage and the parties are unable to agree on the appropriate disposition of the deposit, the Platform provides a structured documentation and communication channel to assist the parties in reaching a resolution. The Platform operator does not adjudicate disputes between Users and does not make binding determinations regarding the allocation of deposit funds. Any unresolved dispute regarding deposit funds remains a matter between the Owner and Renter to be resolved in accordance with applicable Polish law.

Article VI — Delivery Coordination

The Platform provides a module for the coordination of delivery and collection logistics between Owner and Renter. This module allows the parties to agree and document delivery address, collection point, timing and access requirements within the booking record. The Platform operator does not operate transport vehicles, does not employ delivery personnel and does not assume responsibility for the physical delivery or collection of equipment. Delivery and collection are carried out by the parties themselves or by third-party logistics providers engaged by them. The Platform's coordination module is provided as a documentation and communication tool only. Responsibility for the safe and timely delivery and collection of equipment rests with the Owner and Renter as agreed between them and as documented in the rental agreement.

Article VII — Limitation of Platform Operator Liability

The Platform operator provides the Platform as an information and transaction facilitation service. The Platform operator does not verify the accuracy of listing information provided by Owners, does not inspect equipment prior to listing, and does not warrant that listed equipment is fit for purpose, safe or in the condition described. The Platform operator is not liable for: (a) any loss or damage arising from the condition, performance or suitability of equipment rented through the Platform; (b) any loss arising from the failure of an Owner to fulfil a confirmed booking; (c) any loss arising from the failure of a Renter to return equipment in the agreed condition; (d) any loss arising from delivery failures or logistics errors between the parties; (e) any indirect, consequential or economic loss arising from use of the Platform. The Platform operator's liability to any User in respect of any claim arising from use of the Platform is limited to the amount of platform fees paid by that User in connection with the relevant transaction, or PLN 500, whichever is lower. Nothing in these terms excludes liability for death or personal injury caused by negligence, or for fraudulent misrepresentation, to the extent such exclusion is not permitted under Polish law.

Article VIII — Insurance

The Platform operator does not provide, arrange or broker insurance products. Users are solely responsible for obtaining any insurance cover they consider appropriate in connection with their use of the Platform, including but not limited to insurance for equipment damage, theft, third-party liability and business interruption. The Platform's damage deposit mechanism is not an insurance product and does not function as a substitute for insurance. Users are advised to consult an appropriately authorised insurance intermediary regarding their insurance needs.

Article IX — Governing Law and Dispute Resolution

These Terms of Service are governed by and construed in accordance with Polish law. Any dispute arising out of or in connection with these terms, including disputes regarding their formation, validity, binding effect, interpretation, performance, breach or termination, shall be subject to the jurisdiction of the competent courts in Poland. Where a User qualifies as a consumer within the meaning of the Polish Consumer Rights Act (Ustawa z dnia 30 maja 2014 r. o prawach konsumenta), their statutory rights under Polish consumer protection law are not affected by these terms. Information about out-of-court dispute resolution mechanisms available to consumers in Poland, including the platform operated by the President of the Office of Competition and Consumer Protection (UOKiK), is available at www.uokik.gov.pl.

Article X — Amendments to Terms

The Platform operator reserves the right to amend these Terms of Service at any time. Amendments will be published on this page with an updated revision date. Where amendments are material, registered Users will be notified by email or through the Platform's notification system. Continued use of the Platform following the publication of amended terms constitutes acceptance of those amended terms. Where a User does not accept amended terms, they should cease use of the Platform and may request account closure by contacting [email protected].
